Where should I file for divorce?

Assuming that you and your spouse have lived in Texas for at least 6 months, you must file for divorce in the County where you have resided for the three months prior to filing for divorce.


Should I request a temporary Restraining order (TRO)?

In short, it depends on your situation. In certain circumstances, it makes sense to file a TRO for the sake of protecting yourself. Some examples of this might be:

  • If you believe that your spouse is likely to begin selling shared assets or investments in an attempt to keep the money for themselves

  • Terminating, limiting, or charging credit cards in your name

  • If your spouse has threatened violence

  • Intentionally, knowingly, or recklessly causing bodily injury to you

You should always consult with an attorney when deciding whether or not to file a TRO.


Can I get divorced in Texas if my spouse lives out of state?

Yes, you can still get divorced so long as you are a Texas resident at the time the divorce is filed. There are certain exceptions to this general rule, so make sure to consult an attorney right away.
